This document is for informational purposes only and serves as a supplement to the Store’s Terms and Conditions. In the event of any discrepancy, the Terms and Conditions shall prevail.
Right to Cancel the Contract (14 days)
A consumer and a business entity with consumer rights may withdraw from a distance contract within 14 days of taking possession of the Product (delivery of the shipment), without giving a reason and without incurring any costs, except for the costs specified below. To meet the deadline, it is sufficient to send a notice before the deadline expires.
How to Request a Return
A notice of withdrawal may be submitted in any unambiguous manner, including, but not limited to:
- Through your Store Account — in the order view (My Account → Orders → “Product Returns” section): the system indicates which items are eligible for return and accepts the return request online;
- by email to: order@fabrykacmyka.pl;
- in writing to the following address: Fabryka CMYKa Niciak Sp.J., ul. Rynkowska 1, 85-503 Bydgoszcz.
You may use the sample withdrawal form (attached to the Terms and Conditions), but this is not mandatory. Once the request is accepted, the Seller will provide the Customer with the address to which the Product should be returned and confirm the next steps.
Consequences of Withdrawal
- The Seller shall refund all payments received, including delivery costs (except for additional costs resulting from the Customer’s choice of a delivery method other than the cheapest standard option offered by the Store), without delay, no later than 14 days from receipt of the notice, using the same payment method used by the Customer.
- The Seller may withhold the refund until the Product is returned or proof of its return is provided—whichever occurs first.
- The Customer shall return the Product without delay, no later than 14 days from the date of withdrawal, and shall bear the direct costs of returning the Product.
- The Customer is liable for any reduction in the value of the Product resulting from use of the Product beyond what is necessary to ascertain its nature, characteristics, and functioning.
Custom-printed products — no right of withdrawal
The right of withdrawal does not apply to Products with custom printing (markings) that are manufactured according to the Customer’s specifications or designed to meet the Customer’s individual needs—in accordance with Article 38(3) of the Consumer Rights Act. This applies to all orders that include a marking service (e.g., screen printing, DTF, reflective printing). Information regarding the loss of the right of withdrawal is provided, and the relevant consent is obtained, at the time the order is placed.
Finished products (without printing)—including those ordered together with marked products—are returnable under general terms; the order overview in your Account indicates which items can be returned.
Complaint — Nonconformity of the Goods with the Contract
- Consumer and Business Entity with Consumer Rights: The Seller is liable for any lack of conformity of the Goods with the contract in accordance with Chapter 5a of the Consumer Rights Act (for contracts entered into on or after January 1, 2023). The customer may demand repair or replacement, and if this is impossible or would entail excessive costs—a price reduction or withdrawal from the contract (in accordance with statutory provisions). Liability covers any lack of conformity existing at the time of delivery and discovered within 2 years from that time.
- Business customer (purchase for professional purposes): The Seller’s liability under the warranty is governed by the Civil Code, with the possibility of limiting such liability to the extent permitted by law.
How to File a Complaint
Complaints may be submitted by email to order@fabrykacmyka.pl or in writing (ul. Rynkowska 1, 85-503 Bydgoszcz). The complaint should include: the customer’s information, the order number or proof of purchase, a description of the defect (with photos, if possible), and the customer’s request. The seller will respond to the consumer’s complaint within 14 days of receiving it; failure to respond within this period constitutes acceptance of the complaint.
Printing Complaint
Complaints regarding printed products do not cover discrepancies resulting from materials or designs provided or approved by the Customer (e.g., errors in graphics, typos, file resolution, color variations within the technological tolerance limits of the given printing technique—colors on the screen may differ from the actual colors). The Seller is liable for defects in the print that do not conform to the approved design, as well as for defects in the Product itself.
Damage during transport
We recommend that you inspect the package upon delivery. If you find any damage, you may request that the carrier prepare a damage report—this facilitates the processing of your claim, but the absence of such a report does not exclude or limit your rights as a consumer due to the Goods’ nonconformity with the contract.
Alternative Dispute Resolution
Consumers may use out-of-court methods to resolve complaints and pursue claims, including assistance from the district (municipal) consumer ombudsman, the provincial inspector of the Trade Inspection Authority, or a permanent consumer arbitration court.
